Provider and scope of service
tRADUWORKS provides professional translation, localisation, linguistic review, proofreading and post-editing services. The specific scope of each assignment will be determined by the confirmed order, accepted quotation or the client’s written instructions.
Formation of the contract
The contract is deemed to have been concluded when the client confirms an order through the system, accepts a quotation or makes the requested full or partial payment.
The service provider may decline assignments due to lack of availability, technical complexity, incompatibility of the material or absence of essential information.
Rates, payments and deposits
- Rates are calculated according to volume, complexity, format, urgency and technical requirements.
- Projects involving complex files, layout work, extensive revision or technical difficulty may require an advance deposit.
- A surcharge may apply to urgent projects, weekend or public-holiday work, or work performed outside normal business hours.
- The service provider may require full payment before final delivery.
Delivery times and urgent services
Any delivery times communicated are reasonable estimates rather than absolute guarantees, unless expressly agreed otherwise in writing. Delivery times depend on the actual volume, the quality and legibility of the material received, file stability and the client’s prompt response to queries.
Delays will be considered reasonable when they do not substantially affect the purpose of the assignment and arise from technical incidents, necessary clarifications, changes to the material or force majeure.
Included revisions and additional revisions
One reasonable post-delivery revision is included to correct errors attributable to the translation process, provided that the client reports them within 7 calendar days of delivery.
A second revision, stylistic changes, terminology preferences not communicated in advance, rewriting, updates to the source text or new client instructions may be quoted separately.
Client changes and additional work
Any amendment to the source text, extension of scope, change of language, change of format or additional request made after acceptance of the assignment may result in a revised fee, a revised delivery time, or both.
Cancellations, returns and refunds
Due to the personalised nature of the service, work that has already commenced is non-refundable. If the client cancels before work has effectively begun, a full or partial refund may be issued after deducting administrative costs, payment fees already incurred and any preliminary work already completed.
Deposits paid to reserve availability, urgent service capacity or technical review may be non-refundable once the work has been scheduled or commenced.
Use of AI, MTPE and professional tools
Unless specifically agreed otherwise, the client accepts that the workflow may include professional translation tools, translation memories, glossaries, automated quality checks and, where appropriate, artificial intelligence or machine translation with human post-editing.
Intellectual property
The client retains ownership of the original material. Ownership of, or the right to use, the delivered translation is transferred to the client once full payment for the relevant assignment has been received.
Limitation of liability
The service provider’s maximum liability will, in all cases, be limited to the amount actually paid by the client for the specific assignment concerned.
The service provider will not be liable for indirect loss, loss of profit, loss of opportunity, third-party rejection, interpretations of the translated content or consequences arising from the final use of the text.
Third-party acceptance and use of content
tRADUWORKS does not guarantee that translated content will be accepted by authorities, publishers, universities, official bodies, courts, end clients, marketplaces or other third parties, unless a specific certification or requirement has been expressly agreed in writing.
Force majeure and applicable law
The service provider will not be liable for delays or failures caused by events beyond its reasonable control, including technical failures, platform outages, connectivity problems, incidents affecting third-party providers or unforeseeable circumstances.
These terms are governed by Spanish law and the applicable legislation of the European Union.
